The Lucknow Bench of the Allahabad High Court has given a major setback to former minister Azam Khan in the Samajwadi Party government in the UP Jal Nigam recruitment case for 1300 posts of Engineer, Clerk and Stenographer.
A bench of Justice Rajiv Singh passed this order while hearing Azam Khan’s application through video conference. The court said that Azam’s warrant has already been given to him in Sitapur jail on November 19, 2020, so he has already been taken into judicial custody in this case. For this reason this application is not maintainable. Senior advocates Kapil Sibal and IB Singh, appearing for Azam, filed this application and argued that he was wrongly implicated in the case for political reasons.
Opposition to Azam’s application
Additional government advocate Santosh Kumar Mishra, strongly opposing Azam’s application, told the court that Azam is already in judicial custody in this case because the competent court had sent him a warrant in Sitapur jail on November 18, 2020, which will be next. The day was also handed over to him.

On this, Azam’s advocates said that if his judicial custody is assumed, the charge sheet against him in the case was filed on May 24, which was 90 days after his judicial custody. So they should automatically get bail. On this, the High Court said that Azam can apply for this in the competent court.
